The Collaboration Agreement is used when two or more writers are working on a screenplay together and they want to establish ownership, how revenues will be divided and how credit will be accorded.  The Collaboration Agreement is important to have in place prior to the writers working together on their screenplay or teleplay.  Once a production company is interested in the written material, the writers may feel that each contributed more than the other.  Having this Collaboration Agreement in place at the outset will help prevent problems when there is interest by a producer or production company.

COLLABORATION AGREEMENT

            This agreement is dated as of ________________________ (“Agreement”), by and between ______________ (“_____”) and _____________ (“______”), hereinafter sometimes referred to as a “Party” or the “Parties”.

The Parties are collaborating on an original screenplay currently titled “______” (“Screenplay” and/or the “Work”), and are desirous of establishing all their rights and obligations in and to said Work.

NOW, THEREFORE, in consideration of the execution of this Agreement, and the undertakings of the parties as hereinafter set forth, it is agreed as follows:

  1. The Parties shall collaborate in the writing of the Work and upon completion thereof shall be the joint owners of the Work (i.e., the Parties shall own the Work in the following percentages: fifty percent (50%) to ______ and fifty percent (50%) to _________.
  1. Upon completion of the Screenplay, said Screenplay shall be registered for such copyright in the name of both Parties, and each Party hereby designates the other as his/her attorney-in-fact to register such Screenplay with the United States Copyright Office.
